1. Purpose and commercial sales policy
1.1. These General Terms & Conditions of sale (hereinafter also the "Terms") apply to the purchase of "Tre Ponti" branded products (hereinafter "Products" or in the singular "Product") made through the e-commerce website www.treponti.com (hereinafter the "Site") by users as better specified in article 1.2 below. The Products are sold by Tre Ponti S.r.l., with registered office in Villorba (TV), Piazza Aldo Moro, 7, Italy, Tel. +39 0422 968346, shop@treponti.com, C.F./P.IVA 04982290266, REA: TV - 415851, share capital €100,000 i.v. ("Tre Ponti").
1.2. The sale of Products through the Site is aimed at the following types of users:
- natural person who purchases Products on the Site for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried on ("Consumer");
- natural person or legal entity that purchases Products on the Site in the exercise of its entrepreneurial, commercial, craft or professional activity. The inclusion of the VAT Number during the purchase and/or payment phase will be worth considering the Customer as a professional (hereinafter "Professional").

1.3. Any communication from the Customer connected and/or related to the purchase of the Products - including any reports, complaints, requests concerning the purchase and/or delivery of the Products, the exercise of the right of withdrawal, etc. - must be sent to Tre Ponti at the contact details and in the manner indicated on the Site and at the e-mail address shop@treponti.com.
1.4. Each purchase is governed by the Terms in the version that will be posted on the Site at the time the Customer submits the order.
1.5. If the Customer is a Professional, these Terms shall apply to the same. However, notwithstanding the provisions of the same:
- the Professional will not be granted the right of withdrawal referred to in Article 10 of the Terms;
- the Professional shall not benefit from the guarantee on the Products indicated in Article 8 of the Terms. The provisions of Articles 1490 et seq. of the Civil Code shall apply to the Professional;
- in case of disputes in connection with the application, interpretation, execution or breach of these Terms, the provision of Article 13.2 of the Terms shall apply to the Professional.
- the Professional shall not be accorded any other protections, if any, provided herein in favor of the Consumer that reflect or conform to mandatory statutory provisions;
the sales contract concluded between Tre Ponti and the Professional shall be governed by Italian law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods - Vienna Convention of 1980.
1.6. Before submitting a purchase proposal via the Site ("Order Request"), Customers are required to carefully read the Terms available on the Site. It’s possible to archive each Order Request and download the Terms using the relevant browser command. In accordance with the provisions of Article 51 co. 7, Legislative Decree 206/2005 ("Consumer Code") Tre Ponti will send the Customer a copy of the Order with all the necessary information, also by e-mail. The documents can easily be printed or saved using the functions made available by common e-mail programs.
1.7. In order to purchase on the Site, the Customer must be in the age of majority (18 years) and have the capacity to act, which the Customer claims to possess.
1.8. The language used for the conclusion of contracts (as defined below) is Italian or English depending on the Customer's preference.
1.9. Tre Ponti reserves the right to change these Terms at any time, at its sole discretion, without the need to provide any notice to users of the Site. Any changes made will be effective as of the date they are posted on the Site and will apply only to sales completed on or after that date.
2. Characteristics of Products and their availability in different geographical areas
2.1. The Products are sold with the characteristics described on the Site and according to the Terms published on the Site at the time of the conclusion of the contract of sale as defined in Article 3 below, to the exclusion of any other conditions or terms.
2.2. Prices, Products on the Site and/or their characteristics, may be subject to change without notice. Such variations shall operate only for orders not yet confirmed on the date of such variation. In any case, before sending the Order Request pursuant to Article 3 below, the Customer is invited to verify the final sale price.
2.3. The Site can be accessed from anywhere in the world. However, the Products on the Site can only be purchased by users who request delivery to one of the member states of the European Union.
3. Conclusion of the contract
3.1. The presentation of Products on the Site, which is not binding for Tre Ponti, represents a mere invitation addressed to the Customer to make a contractual proposal to purchase and not an offer to the public. The transmission of the Order Request constitutes a purchase proposal relating to the selected Product and is binding on the Customer, subject to the right of withdrawal provided for in Article 10.
3.2. Once the Order Request has been submitted, the Customer will receive an automatic message confirming the Order Request. Only when the Customer receives confirmation of acceptance of the Order Request (hereinafter "Order Confirmation"), the purchase order between the Customer and Tre Ponti (referred to as the "Order" or plural "Orders") shall be deemed to be formalized and, therefore, the related contract for the sale and purchase of the Products (referred to as the "Contract" or plural "Contracts") shall be concluded.
3.3 The Customer's Order Request may be rejected in the following cases:
(i) in case of product exhaustion;
(ii) in case the payment fails;
(iii) in case of entering incomplete, incorrect or invalid shipping address;
(iv) in case the delivery address is not territorially covered under these Terms;
(v) if the Product ordered indicates, at the time the Order Request is sent, a price manifestly lower than the price normally charged pursuant to Article 4.6 below
(vi) if the delivery address given corresponds to the address of a legal entity or an individual providing shipping services, in the absence of an agreement with Tre Ponti;
(vii) due to force majeure or in case of Site malfunction.
3.4. In the event that the Order Request is rejected due to a data entry error of the Customer, Tre Ponti's customer service may contact the Customer, either by telephone at the number provided during the purchase procedure or through the Customer's e-mail address, to provide information about the failure of the purchase procedure and the correct way to proceed with the renewal of the order.
4. Procedure for selection and purchase of Products
4.1. The Products presented on the Site may be purchased by selecting the Products of interest, specifying - in the hypotheses that provide for it - the size and color of the Product, and placing them in the appropriate virtual shopping cart.
4.2. After selecting the Products, in order to proceed with the purchase of the Products placed in the shopping cart, the Customer will be asked to (i) register with the Site, providing the requested data, or (ii) to log in, if the Customer is already registered or (iii) to provide their data in order to complete the Order Request.
4.3. If the data indicated in the Order Request are different from those provided during registration on the Site, the Customer will be asked to confirm their data (eg. first name, last name, etc.), as well as the address where to deliver the selected Products, the billing address and, optionally, a telephone number where they can be contacted for any communications relating to the purchase made.
4.4. The Customer will display a summary of the Order Request to be sent, accompanied by the price of the selected Products and the shipping costs, will be asked to choose the payment method and enter the required payment details and, after careful reading, must expressly approve these Terms, through the appropriate check-box on the Site. Finally, through the " Place Order" button, the Customer will be asked to confirm his Order Request, which will thus be definitively sent to Tre Ponti.
4.5. For accounting and administrative needs, Tre Ponti reserves the right to verify the general information provided by the Customer. If payment is made by credit card, the purchase amount will be charged exclusively at the time of transmission of the Order Confirmation from Tre Ponti to the Customer.
4.6. If during the selection of the Products, the Customer finds that the price of one or more of the Products he intends to select for subsequent purchase is manifestly lower than the price normally applied, net of any discounts and/or promotions in force at that time, due to an obvious technical problem occurring on the Site, he is requested not to send the Order Request and to report the aforementioned technical error to Tre Ponti’s Customer Service by sending an e-mail to: shop@treponti.com.
5. Delivery of goods and acceptance
5.1. The Site indicates the availability of the Products and the delivery times of the Products. Such information is to be considered purely indicative and not binding on Tre Ponti.
5.2. Tre Ponti will send the Customer the Order Confirmation e-mail pursuant to Article 3.2. which will also contain a confirmation that the Products have been shipped to the address indicated by the Customer and the tracking number to track and check the progress of the shipment.
5.3. The Products will be delivered to the delivery address indicated by the Customer at the time of the Order Request. Tre Ponti shall not be liable if the delivery address given is incorrect or incomplete. Please also note that there are restrictions on the locations to which Tre Ponti delivers Products under Article 2.3 above.
5.4. In case of unavailability of the addressee or other person authorized to receive the shipment at the time of the delivery attempt, the courier will make a further delivery attempt on the next day. In case the second attempt is also unsuccessful, the courier will issue a paper notice containing its contact details and the pick-up point at which it will be possible to collect the products.In some cases, the courier may deposit the shipment directly at a pick-up point even without issuing a paper notice. In such cases, the Customer will receive a specific communication from the courier by e-mail or SMS. The Customer is required to check the shipment status through the tracking link provided by the Seller in order to verify any updates regarding the storage or availability of the parcel at a pick-up point. If the Customer does not pick up the products from the pick-up point within 10 days, the ordered products will be returned to the warehouse. Customer service will contact the Customer to agree whether to proceed with a new shipment of the ordered products or to make a refund of the relevant payment, deducting the expenses for the unsuccessful Product delivery, the expenses for returning the Product to Tre Ponti and any other expenses it may have incurred due to the recipient’s absence. The user shall be informed of the contract termination and the amount of the refund by e-mail.
5.5. Tre Ponti undertakes to do everything within its power in order to respect the delivery times indicated on the Site and, in any case, to execute the delivery within a maximum time of 30 (thirty) days from the day following the date of conclusion of the Contract. If it is impossible to execute the Order, due to the unavailability, even temporary, of the Product, Tre Ponti will provide written notice to the Customer and will refund any sums already paid by the Customer for the payment of the Product. If the Customer has chosen bank transfer as the method of payment, the delivery period will run from the receipt of the consideration by Tre Ponti.
5.6. The shipment of the Products ordered by the Customer will be made in the selected method at the time of sending the Order Request. The Customer undertakes to promptly check that the delivery includes all and only the Products purchased and to promptly inform Tre Ponti of any defect in the Products received or their discrepancy from the Order placed, in accordance with the procedure set forth in Article 8 below of these Terms, failing which the Products shall be deemed accepted. Should the package or wrapping of the Products ordered by the Customer arrive at the destination obviously damaged, the Customer is invited to refuse delivery by the carrier/freight forwarder or to accept delivery "with reservation".
6. Prices, shipping costs, taxes and fees
6.1. The price of the Products is the one indicated on the Site at the time the Customer sends the Order Request. Prices include standard packaging costs, VAT and any indirect taxes (if applicable), while they do not include shipping costs that are calculated during checkout and that the Customer agrees to pay to Tre Ponti in addition to the price indicated on the Site.
6.2. The price of the Products is shown in accordance with the regulations on announcements of price reductions contained in Legislative Decree No. 26/2023 transposing Dir. (EU) 2019/2161. Therefore, each price reduction announcement will show the lowest price applied by Tre Ponti in the 30 days prior to the application of such reduction, within the limits and pursuant to the provisions of the aforementioned legislation.
6.3. Shipping charges are free for orders over € 62.00 if the delivery address is located in Italy. For orders below € 62.00, shipping costs are € 5.50 for shipments within Italy, excluding islands for which they are € 6.50.

6.5. The Customer declares that the lack of knowledge of the costs, charges, duties, taxes and/or levies referred to in Articles 6.3. and 6.4. above, at the time of sending an Order Request to Tre Ponti, shall not constitute cause for termination of the Contract and that it shall not in any way charge these charges to Tre Ponti.
6.6. Any and all additional costs, charges, fees and/or taxes that any given country may impose, for whatever reason, on the Products ordered under these Terms shall be borne solely by the Customer. The Customer is responsible for paying all duties, customs clearance fees, and import charges.
6.7. Tre Ponti will fulfill the Order by entrusting the Products to the courier or forwarding agent of trust (hereinafter the "Forwarder"), depending on the State of dispatch, for shipment to the address indicated by the Customer and summarized in the Order Confirmation.
6.8. The Products will be delivered within the maximum period provided for in Article 61 par. 1 of the Consumer Code. For deliveries made within the Italian territory, Tre Ponti foresees a maximum delivery period of 5 working days starting from the receipt of the Order Confirmation. Otherwise, for international shipments, the maximum period provided is 8 working days starting from the receipt of the Order Confirmation.
6.9. In the event that a problem occurs with the courier during transportation and the package does not arrive at its destination within the above indicative period, the Customer will promptly notify Tre Ponti, who will attempt to resolve the issue within a reasonable period of time.
6.10. The delivery terms referred to in Article 6.8 are indicative only and not guaranteed. No liability, in any capacity whatsoever, may be incurred by Tre Ponti if the products are not delivered in accordance with the indicative time limit set forth in this paragraph.
6.11. No liability can be attributed to Tre Ponti for delays in the delivery of Products due to unforeseeable circumstances or force majeure, as well as in the event of strikes, atmospheric events, special holidays, warehouse inventories, relocations, changes in information systems and other extraordinary events; these are likely to cause delays exceeding the indicative time in the fulfillment of orders, even in the order of several days.
6.12. In any case, should the delivery time of the ordered Product be delayed with respect to the delivery time indicated on the Site or these Terms, Tre Ponti undertakes to give prompt notice to the Customer via e-mail.
7. Payments and billing
7.1. Payment of the price of Products purchased on the Site must be made at the same time as the Order Request.
7.2. For payment of the price of the Products and related shipping costs, the Customer may choose one of the methods indicated in the Order Request form at check-out.
7.3. If payment is made by credit card, the Customer will be transferred to a secure site and all details (such as, for example, card number, expiration date, CVC) will be forwarded via encrypted protocol to the remote electronic payment service provider, without third parties being able to access them in any way. This information will only be used by Tre Ponti to complete the purchase process or to issue refunds in case of returns or to report cases of fraud to the police.
7.4. If payment is made by bank transfer, the Customer is required to indicate in the reason for payment the order number received in the Order Confirmation e-mail.
7.5. Tre Ponti will promptly transmit to the Customer, where required by applicable law, in electronic format via email, the tax receipt relating to the purchase made, if the Products purchased are intended to be delivered within the Italian territory, or attached in paper format to the Products purchased, in all other cases.
7.6. If the Customer wishes to receive an invoice, the Customer shall select the appropriate option on the Site and provide the requested data before transmitting the Order Request. The data for the issuance of the invoice shall be those entered by the Customer in the billing address field. No changes to the invoice are allowed after it has been issued.
8. Legal Warranty of Conformity and Returns Policy
8.1. Pursuant to and for the purposes of European Directive 771/2019/EC and the Consumer Code, Tre Ponti warrants that the Products will be free of material and design defects and conform to the descriptions on the Site for a period of twenty-four (24) months from delivery. The warranty does not apply if the Product is used improperly with respect to its intended purpose, if it is cut, modified, washed differently from what Tre Ponti indicated, or if it shows signs of wear and tear or chewing. In addition, Tre Ponti warrants that the Product will be of standard quality in terms of quantity, quality, durability, functionality, compatibility, and safety.
8.2. Tre Ponti is liable to Customers, pursuant to Article 129 of the Consumer Code, for any lack of conformity of the products existing at the time of delivery. A lack of conformity is deemed to exist if: (i) the Product is not suitable for the use for which goods of the same type are customarily used; or (ii) it does not conform to the description or does not possess the qualities referred to in the sample or model that may have been made available to the Customer; or (iii) it does not offer the usual qualities and performance of goods of the same type that the Customer may legitimately expect; or (iv) it is not suitable for the particular use intended by the Customer if brought to the knowledge of Tre Ponti at the time of purchase. It is understood that the Product may differ in some marginal respects from the image shown on the Site (e.g., color).
8.3. Under penalty of forfeiture of this warranty, the Consumer may report any defects and non-conformities within 2 (two) months of their discovery, likewise, the Professional must notify any defects or non-conformities within 8 (eight) days of their discovery, by transmitting by e-mail to shop@treponti.com, the appropriate form correctly filled out, indicating the defect and/or non-conformity found, as well as the relevant documentation indicated in the form itself (at least no. 1 (one) photograph of the Product, the Order Confirmation sent by Tre Ponti and/or the tax receipt).
8.4. After the reception of the return form and related documentation, Tre Ponti will assess the defects and non-conformities reported by the Customer through the support service and, after having carried out the qualitative checks aimed at verifying the actual non-conformity of the Product, will decide whether to authorize the return of the Products by providing the Customer with feedback via e-mail to the address provided by the latter during the registration process on the Site or when transmitting the Order Request. The authorization to return the Products shall in no way constitute recognition of defects or non-conformities, the existence of which must be ascertained after the return. The Products for which Tre Ponti has authorized the return must be returned by the Customer, together with a copy of the return authorization notice, within 30 (thirty) days from the reporting of the defect or non-conformity, to the following address: shop@treponti.com.
8.5. If the existence of defects or non-conformity of the Products is ascertained, the Consumer shall have the right to choose between the repair of the Product or its replacement in accordance with the provisions of articles 135-bis et seq. of the Consumer Code.
8.6. If Tre Ponti has undertaken to refund the Customer the price paid, the refund will be made, where possible, by the same means of payment used by the Customer when purchasing the Product or by bank transfer. It will be the Customer's responsibility to notify Tre Ponti via e-mail at shop@treponti.com of the bank details for making the transfer in its favor and for Tre Ponti to be put in a position to make the refund.
9. Warranty exclusions and limitations
9.1. The warranties set forth in Article 8 of these Terms are excluded if the Customer has damaged the Products through its own willful or negligent conduct, or otherwise if, through its negligence and/or carelessness and/or for other reasons not attributable to Tre Ponti, it has damaged and/or rendered the Products defective, and/or exposed them to natural events and/or used them improperly and/or without following the technical instructions set forth in any manuals.
9.2. Warranties are also excluded if the defects and/or malfunctions result from use of the Products other than that for which they were designed and manufactured, or in cases of normal wear and tear or deterioration of consumable parts.
10. Right of Withdrawal and Returns Policy
10.1. Without prejudice to the exceptions set forth in Article 59 of the Consumer Code, the Customer is granted the right to withdraw from any contract concluded pursuant to these Terms, without having to provide any reasons and without incurring costs other than those provided for in Article 56 paragraph 2 and Article 57 of the Consumer Code, within the term of 14 (fourteen) days from when (i) the Product has been delivered or (ii) in the case of the purchase of several Products delivered separately in a single Order, the last Product has been delivered.
10.2. In order to exercise the right of withdrawal, the Customer must inform Tre Ponti, before the expiration of the period referred to in Article 10.1 above, of its decision to withdraw by contacting Tre Ponti at the e-mail address shop@treponti.com or by sending a WhatsApp message to +39 335 691 7009 and following the instructions that will be rendered by the customer service.
10.3. Following the provisions of point 10.2 above, the Consumer will receive a communication with instructions on how to proceed with the return of the product, which must be sent no later than the next 14 days to Tre Ponti S.r.l., Via Santandrà 39 - 31050, Ponzano Veneto (TV) - Italy.
10.4. The direct risks and costs of returning the Products, as well as the proof thereof, shall be borne by the Consumer. Before confirming the request for withdrawal, the cost of returning the goods will be indicated to the Consumer. Any customs duties, import charges, or taxes arising from the return of goods from non-EU countries shall also be borne by the customer.
10.5. In the event of withdrawal, the Consumer shall be refunded the payments, including delivery costs (except for additional costs arising from any choice of a type of delivery other than the least expensive type of standard delivery offered), pursuant to and in accordance with the terms provided for in Article 56 paragraph 3 Consumer Code. Said refunds will be made using the same means of payment used by the Consumer for the initial transaction, unless the Consumer has expressly agreed otherwise. Refunds may be suspended until receipt of the goods or until the Consumer demonstrates that he/she has returned the goods, whichever is earlier.
10.6. The Consumer shall be liable for any decrease in the value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods. Therefore, if the returned goods are damaged (e.g. with signs of wear and tear, dirtiness, chewing, abrasion, scratching, deformation, presence of animal hair, indications of use beyond simple testing, etc.), not complete with all their elements and accessories (including labels and tags unaltered and attached to the product), not accompanied by the attached instructions/notes/manuals, original packaging and packing and the warranty certificate, if any, the Consumer shall be liable for the patrimonial decrease in the value of the goods, and shall be entitled to a refund of the amount equal to the residual value of the Product. To this end, therefore, the Consumer is asked not to handle the good beyond what is strictly necessary to establish the nature, characteristics and operation of the Products and to cover the original wrapping of the Products with other protective packaging that preserves its integrity and protects it during transport even from writing or labels.
10.7. The Consumer must pay the utmost attention also when returning the goods: it is strictly prohibited to fold or compress the Products in an unnatural way that may cause deformations, permanent creases, or damage to the materials during transport. Products must be laid flat to avoid any deformation. In case of doubts regarding the correct packaging methods, the Consumer is encouraged to contact our Customer Service in advance.
11. Intellectual property rights
11.1. The Customer declares to be informed that all trademarks, names, as well as any distinctive sign, denomination, image, photograph, written or graphic text used on the Site or relating to the Products are and remain the exclusive property of Tre Ponti S.r.l and/or its assignees, without any right deriving to the Customer from access to the Site and/or the purchase of the Products.
11.2. The contents of the Site may not be reproduced in whole or in part, transferred by electronic or conventional means, modified, or used for any purpose without the prior written consent of Tre Ponti S.r.L.
12. Processing of personal data
12.1. In order to proceed with the registration to the Site, the submission of an Order Request and thus the conclusion of the Contract based on these Terms, certain personal data are required from the Customer through the Site. The Customer acknowledges that the personal data provided will be collected and processed by Tre Ponti in accordance with the provisions of Privacy Policy.
13. Applicable law, dispute resolution and place of jurisdiction
13.1. Any Contract concluded between the Tre Ponti and a Consumer pursuant to these Terms shall be governed by and construed in accordance with Italian law and in particular by the Consumer Code, with specific reference to the regulations on distance contracts and by Legislative Decree 9 April 2003 No. 70 on certain aspects concerning electronic commerce. In any case, the rights that may be attributed to Customers by mandatory provisions of law in force in the State of the latter shall not be affected.
13.2. In the event that disputes arise between Tre Ponti and a Professional in relation to the application of this Contract, or otherwise related to the performance, interpretation or breach of these Terms, they shall be submitted to the exclusive jurisdiction of the Court of Treviso.
13.3. In the event of a dispute between Tre Ponti and a Customer, we guarantee as of now our participation in an attempt at friendly conciliation that each Customer may promote before RisolviOnline, an independent and institutional service provided by the Arbitration Chamber of the Chamber of Commerce of Treviso, which allows a satisfactory agreement to be reached, with the help of a neutral and competent conciliator, in an amicable and secure way over the Internet. 13.4. If the attempt at conciliation referred to in paragraph 13.2 or 13.3 above is not adhered to or such attempt is unsuccessful, the dispute shall be referred to the court of the place of residence or domicile of the Consumer, in accordance with the rules provided by the Code of Civil Procedure for the Professional or in accordance with EU Regulation No. 1215/2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters.
14. Complaints, communications and information
14.1. For any information or complaint, or for any communication regarding these Terms, orders and/or "Tre Ponti " Products, the Customer may contact Customer Service free of charge by email at shop@treponti.com
